These Terms and Conditions (“Agreement”) are a legally binding contract between you (individually or on behalf of an entity, collectively, “You”) and RVing Trends (“RVing Trends,” “we,” “us,” or “our”). By using our website at rvingtrends.com (including any mobile version) (collectively, the “Site”), or purchasing products through affiliate links provided on the Site (“Affiliate Links”), You: (1) agree to be bound by this Agreement, including the additional terms referenced in Section 1 below (the “Additional Terms”), and (2) represent that You are at least eighteen (18) years old and, if You are using the Site on behalf of an entity, You have full authority to bind that entity to this Agreement. IF YOU DO NOT AGREE TO THIS AGREEMENT OR THE ADDITIONAL TERMS, OR IF YOU LACK AUTHORITY TO BIND YOUR ENTITY, YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE SITE.

Additional Terms

(a) Please review the RVing Trends Privacy Policy (“Privacy Policy”). The Privacy Policy applies to You and is incorporated into this Agreement by reference.

(b) Other policies referenced in this Agreement and hyperlinked on the Site may also apply to You and are incorporated herein by reference.

Site Content

The Site and all information, text, graphics, data, and other materials made available on or through the Site (excluding content You provide in comments or reviews) and in communications from RVing Trends (collectively, “Site Content”) are owned by RVing Trends or our suppliers and are protected by intellectual property laws. Subject to Your compliance with this Agreement, RVing Trends grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and view the Site Content for Your personal or internal business purposes.

Except as expressly permitted by this Agreement or applicable law, You may not copy, download, upload, print, display, perform, reproduce, publish, license, post, transmit, modify, create derivative works of, reverse engineer, adapt, distribute, or exploit any Site Content, in whole or in part, without our prior written consent. Any copies You make must retain all copyright and other proprietary notices.

Your Account

To use certain features of the Site, You may be required to register for an account. You are responsible for maintaining the confidentiality of Your login credentials and for all activities occurring under Your account. You agree to (i) promptly notify us of any unauthorized use of Your account or other security breach, and (ii) sign out at the end of each session. RVing Trends is not liable for any loss or damage arising from unauthorized use of Your account unless directly caused by our gross negligence.

Affiliate Links and Third-Party Products

RVing Trends participates in affiliate marketing programs. This means:

• We may display or link to products offered by third-party sellers.
• If You click on an Affiliate Link and make a purchase, RVing Trends may earn a commission, at no additional cost to You.
• All transactions and orders are handled by the third-party retailer, not by RVing Trends.

You acknowledge and agree that RVing Trends does not control, manufacture, warehouse, or ship all the products displayed on the Site. In case you purchase the products from third-party retailer, your contractual relationship for any purchase is strictly between You and the third-party retailer, and such transactions are subject to that retailer’s terms and conditions.

RVing Trends is a participant in the Amazon Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com.

As an Amazon Associate, we earn from qualifying purchases. (at no extra cost to you).

We do not specifically market to children under 13.

Representations and Warranties

You represent and warrant that:

(i) You have all rights necessary to submit any information or content to the Site;

(ii) Such content does not infringe or misappropriate any third party’s intellectual property or proprietary rights;

(iii) Your use of the Site will not violate any law, statute, ordinance, or regulation;

(iv) Any content You provide will not be defamatory, libelous, unlawfully threatening or harassing, or advocate, promote, or provide assistance involving violence or other unlawful activities;

(v) Any content You provide will not be obscene or contain child sexual abuse material;

(vi) You will use commercially reasonable efforts to ensure any information or content You provide through the Site is free of viruses, worms, malware, or other harmful code; and

(vii) You will not attempt to use the Site to collect personally identifiable information of any person in a way that breaches any agreement or representation made to such person, and You will not attempt to collect personal information from anyone You know or reasonably should know is under the age of 13.

You further agree not to sublease or otherwise provide third parties with access to Your account and not to engage in activities that create liability or undue risk for RVing Trends, its affiliates, or service providers. Violation of this Section constitutes a material breach and may result in immediate suspension and/or termination of Your access to the Site.

Indemnification

You agree to indemnify, defend, and hold harmless RVing Trends, its affiliates, suppliers, service providers, and their respective officers, directors, agents, and employees (collectively, the “Indemnified Parties”) from and against any and all losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ and expert fees) arising out of or related to: (a) Your breach of Section 6; (b) any content You provide; (c) Your use of the Site; or (d) claims arising from Your breach of this Agreement or the Additional Terms.

Feedback

If You provide ideas, suggestions, or feedback regarding the Site, Site Content, or Affiliate Links (collectively, “Feedback”), RVing Trends will own all right, title, and interest in such Feedback, including all related intellectual property rights, and may use it for any purpose without compensation or attribution to You. To the extent an assignment is not enforceable, You grant RVing Trends a worldwide, perpetual, irrevocable, exclusive, transferable, fully paid, royalty-free license to use and exploit the Feedback.

Third-Party Links

The Site may contain links to third-party websites. These sites are not under RVing Trends’ control, and we are not responsible for their content or practices. We provide links as a convenience and do not endorse or warrant third-party sites. Your use of such sites is at Your own risk and subject to those sites’ terms and policies.

Disclaimer of Warranties

THE SITE, SITE CONTENT, AND AFFILIATE LINKS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” RVING TRENDS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SITE, SITE CONTENT, OR AFFILIATE LINKS ARE ACCURATE, COMPLETE, CURRENT, ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS SECTION MAY NOT APPLY TO YOU.

Limitation of Liability

IN NO EVENT WILL RVING TRENDS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF USE) ARISING OUT OF OR RELATING TO THE SITE, SITE CONTENT, AFFILIATE LINKS, OR THIS AGREEMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. RVING TRENDS’ TOTAL CUMULATIVE LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE GREATER OF FIFTY DOLLARS (US $50) OR, IF YOU HAVE PAID FOR ANY OPTIONAL SERVICES, THE FEES PAID BY YOU DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; IN SUCH CASES, THE FOREGOING LIMITATIONS WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Changes to this Agreement

We may update this Agreement (including the Additional Terms) from time to time. If we make material changes, we will notify You by email (if we have Your email on file) or by posting a notice on the Site. Unless otherwise stated, changes become effective thirty (30) calendar days after email dispatch or posting, whichever occurs earlier, and are effective immediately for new users. Your continued use of the Site after the effective date constitutes acceptance of the updated terms. If You object to changes, Your sole remedy is to stop using the Site and terminate Your account.

Modifications to the Site

We may modify, suspend, or discontinue the Site, Site Content, or Affiliate Links (in whole or in part) at any time with or without notice. We will not be liable to You or any third party for any such modification, suspension, or discontinuation.

General Provisions

Independent Contractors. The parties are independent contractors; this Agreement does not create an agency, partnership, joint venture, employment, or franchise relationship.

Assignment. You may not assign, transfer, or delegate this Agreement without our prior written consent; any attempted assignment in violation of the foregoing is void. RVing Trends may assign this Agreement in its sole discretion.

Severability; Waiver. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force. No waiver of any term is a further or continuing waiver of that term or any other term.

Governing Law; Venue. This Agreement is governed by the laws of the State of New York, without regard to its conflict of laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York for any action arising out of or relating to this Agreement.

Entire Agreement. This Agreement, together with the Additional Terms, constitutes the entire agreement between You and RVing Trends regarding the Site and supersedes all prior or contemporaneous understandings on the subject matter.
